Dear Assembly Member,
I urge you to vote for AB 1313 when it comes before you in the Senate Labor Committee on June 27.
This bill would make the overtime rules for farm laborers the same as for most other workers. Under current California law, most workers qualify for overtime pay once they work more than 8 hours in a day or 40 hours in a week. However, agricultural workers must work more than 10 hours a day or 60 hours a week before they qualify for overtime pay. This distinction is inexcusable.
The laws that require overtime pay for work beyond the normal work day or work week have a very good purpose. Particularly in the case of hard physical labor, such as farm labor, working a normal day can be physically draining. Working overtime in such hard physical labor is really asking a lot of such employees. They should get the higher rate of overtime pay for going the extra mile for their employers.
It is inexcusable that people in the very hard labor of agricultural work must work longer hours to qualify for overtime pay than say a receptionist or a typist.
Farm laborers are put at a disadvantage in two ways. On average, they are among the lowest paid workers in the state and they must work longer hours before they qualify for overtime pay. Both of these things contribute to the fact that most people in farm labor remain poor all their lives.
We really need to increase the basic wages for farm laborers to a more reasonable level. But, until that happens, we certainly need to require employers to pay them overtime pay after working 8 hours a day or 40 hours a week like most other workers.
That is what AB 1313 would require. Please vote for this important bill.
