Dear Senator,
I urge you to vote for AB 1700 when it comes before you in the Senate Governance And Finance Committee on June 20.
This bill will protect two people who own their home together, but who are neither married nor registered domestic partners. It says that, in these cases, if one of them dies, their home will not be re-assessed, and the death of one owner will not allow counties to raise property taxes on the home. Currently, in such situations, counties can re-assess the home on the death of one of the home owners. In some situations that can mean a significant increase in property taxes.
This affects many people. There are probably tens of thousands of same sex couples who own their home together, but who have never married or registered as domestic partners. And with opposite sex couples, more and more of them are living together, and building a family, but not marrying.
Currently, of course, home values are way down and property taxes are unlikely to be raised on the death of one of the owners. However, eventually things will return to normal and home prices will begin rising again. This could indeed mean a significant rise in property taxes on the death of one of the owners.
Prior to the death of one homeowner, the household was supported with two incomes. After the death of one of the owners, that income could be reduced by half or more. In such situations, a rise in property taxes could bring considerable hardship to the survivor, especially if there are children involved.
AB 1700 makes good sense. It will contribute to the economic security of California families regardless of their marital status. Please vote for AB 1700.
