Dear Assembly Member,
I urge you to vote for AB 2040 when it comes before you on the floor of the Assembly.
AB 2040 would allow the courts to seal the records of youth who were made wards of the court for having engaged in prostitution.
Here is why this bill is important. According to a recent report from the National Network for youth, there are an estimated 162,000 homeless youth in the United states who have been the victims of commercial sexual exploitation.
Often their participation in prostitution has been "survival sex". They engage in it because they have no other way of paying for food and lodging to survive. Often they are preyed upon by adults who encourage them, or force them, to engage in prostitution. Picture an Oliver Twist with a Fagin who provides young boys and girls with food, and a place to stay, in return for prostitution, rather than for picking pockets.
The bottom line is that most of these young people are victims rather than criminals. In very many cases, they engage in prostitution in order to survive, or because they are being forced to by adults. If their convictions for prostitution remain unsealed, it can ruin the rest of their lives.
These youth should be allowed to show that they were the victims of sexual exploitation. They should be allowed to show evidence that they have reformed and will no longer engage in prostitution. And, if they can provide convincing evidence of that, the court should be allowed to seal their records.
That is what AB 2040 would do. Please vote for AB 2040.
