On March 31, 2009, a special election in the 20th Congressional District of New York State filled the seat vacated January 26 by Sen. Kirsten Gillibrand, who was appointed to the Senate by Governor David Paterson. Eight months later, a special election in the 23rd Congressional District was held on November 3, 2009 for the seat vacated by Secretary of Army John McHugh, who resigned from Congress September 21, 2009.

Here in the 29th District, where our seat was vacated on March 9, 2009, Governor Paterson has broken his promise to call a special election "as soon as possible,” citing “serious concerns about the financial impact a special election may have.”

Apparently these financial issues are only considered if a district is in Western New York.

To say that the Governor is playing politics is an understatement. Six hundred and sixty thousand western New Yorkers had no voice in the House on “Health Care Reform” and no voice on the government takeover of the student loan industry. We will not have a voice on coming issues such as “Cap and Trace,” immigration reform, and the on-going appropriations process that will decide the 2011 Federal budget.

American Revolutionary and Boston politician James Otis famously used the phrase "taxation without representation is tyranny.” There is no doubt that Governor Paterson’s decision not to call for a special election in the 29th district is unwise, unjust, and tyrannical. Government derives its just powers from the consent of the governed.
Without an election, there is no representation. Without representation, there is no consent. Without consent, the government is no longer just.

We, the undersigned, strongly urge Governor Paterson keep his promise to call for a special election “as soon as possible” so that the 29th district can once again believe that the individuals in our state and federal governments are truly acting in the best interest of all of the people of New York State.
